Timm Training & Consulting LLC is a limited liability company established in the State of Minnesota and operates under and in accordance with Minnesota State Laws including sales tax regulations. Timm Training & Consulting LLC is also doing business as Patrol Tactical and Learning Firearms. Herein after Timm Training & Consulting LLC, DBA Patrol Tactical, DBA Learning Firearms, may be referred to as Timm Training & Consulting LLC, Timm Training & Consulting, Patrol Tactical, Learning Firearms, and/or we, us, or simply “the company.”

Product Information & Warranties

It is our goal to provide accurate information about all of the products and services listed on the website.  We received this information from manufacturers, distributors and other industry sources.  This information could include, but is not limited to:  Size, color, dimensions, weight, fit, applicability, compatibility with other products, technical specifications, material(s), lumens, clarity, magnification, and/or any other information about the product or service.  We can not guarantee all of the information is accurate, however it is our goal and intention to provide accurate and factual information.  In the event it is learned that a product differs from the information on the website, contact us immediately and we will correct the information as well as the source who provided us the information.  We can not guarantee a refund or return on clerical errors on information that was out of our control or provided to us by a reputable source.  Due to manufacturing processes, tolerances, and variations we can not guarantee all product to be dimensionally accurate.  Situations involving issues that arose during manufacturing processes may have to handled directly with the manufacturer.


All warranty issues with products or goods sold on this site are to be honored by the manufacturer per the terms provided by the manufacturer for the period of time the manufacturer specifies.  We can not make any guarantee, promise or warranties whether expressed or implied on any and all products or goods sold.  Any warranty claims are to be made directly with the manufacturer, these claims can include but are not limited to workmanship, defects, materials, fit, use, breakage, wear, function, or any other issue.   We would be happy to assist you in filing a warranty claim with the manufacturer.


From time to time we may offer our customers special purchasing options or group buys.  In these events orders are received, payments collected, merchandise ordered and then delivered to the customer.  We make every best effort to make these group buys occur, however occasionally situations arise where a group buy must be cancelled.  These situations include failing to meet a minimum order amount, availability from manufacturer, discontinued or unavailable product or logistic issues.  We reserve the right to cancel group buys for any of those reasons with notice delivered to the customer.  If payment has been received it will be handled in compliance with our return policy.


Risk of Loss

All products purchased through us are made with the understanding that once a shipping contract is in place, the responsibility of delivery of those products falls to the carrier and/or the customer.  Upon delivery or transfer of the products by us to the carrier, the risk is transferred to you or the carrier.  We will make every best effort to assist in matters of lost or damaged good during shipment but can not guarantee or be responsible for products after they are delivered to the carrier.


Typographical Errors

In the event a typographical error occurs, we reserve the right to cancel or refuse any orders for that item containing the error whether or not we have received payment or a financial transaction card has been charged.  We are human and occasionally mistakes are made, however we strive to provide accurate information.  Errors involving price or availability will be cancelled and the customer will be given the opportunity to continue with the order at the correct price.  In the event the error was involving availability, orders that contain items that are unavailable or out of stock may be cancelled or refused at the time of order.  If the item is available to be back-ordered that option will be made available to the customer.  The customer much decide within 3 business days if they wish to continue with a back order, if no response is received after 3 business day the order will be cancelled.  If orders are refused or cancelled any payments received will be refunded back to the customer with in 3 business days.


Payments

Payment for classes are due at the completion of registration, registration is not finalized until a payment is received. Once we receive your payment you will be notified that your payment has been received and your registration is final and you slot of class is secure.  Payment is required on all items, merchandise or goods before they will be delivered, shipped, or transferred to you.  All items that service(s) are being performed on will not be released until payment is received.  Products in our care and custody for service will be held as a civil lien until complete payment is received.  We accept cash, check and money orders for payment at the listed prices.  Credit card payments may be charged a 4% fee based on the subtotal, this is allowable by Minnesota State Statute for credit card processing merchant fees.  We don't like it either but we would rather not increase class rates and service fees to compensate for the convenience of paying with a card.  These are the fees that are passed on to us.  We are working on obtaining better rates to eliminate the fees, however being a small business limits our options.  We encourage you to pay with cash or check for the best pricing.


For group buy, specials or promotions payment is required at the time of order confirmation.  Your payment is required prior to us having the item in stock for those items only.


Redemption of Free Products, Discounts, and Coupon Offers

From time to time, Timm Training & Consulting LLC offers its clients special offers, promotions, and/or discount codes to be used in conjunction with this website. These offers are frequently disseminated via this website and through email to those who have registered for our email database. They are sometimes posted on our home page(s) or announced via other means of communication in conjunction with the promotion of the Timm Training & Consulting LLC product collection, including radio and TV broadcasts, internet forums and various online websites and social media networks such as Facebook and Youtube.


We encourage our clients to redeem these special offers, but we respectfully ask that you not exploit them. Timm Training & Consulting LLC, at our sole discretion, will determine if all purchasing criteria has been met to qualify for stated discount or free product. If you successfully circumvent the software safeguards of this website in order to receive several free or discounted products with your order, then we will (at our sole discretion) remove any extraneous free or discounted product from your order or cancel the order in its entirety. . In the event the website and/or e-commerce software is malfunctioning, applies a discount in error, applies a discount to products outside of the directed products, your order will be adjusted to the correct price.  Example: You have a coupon for a 10% discount on any item in category X,  however upon checkout the coupon code is applied to all of your order, including items not in category X.  In that situation the price of items not in category X would be adjusted to their actual listed price.  We do our best and it is always our intention to have accurate prices throughout the check out process, if something is malfunctioning please, play fair and do not exploit the error.

Applicable Law

By visiting our website(s), you agree that the laws of the state of Minnesota, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Timm Training & Consulting LLC.


Changes in Policy

Timm Training & Consulting LLC reserves the right to modify, alter, delete and update these policies at any time we see fit. Such alterations do not nullify our rights if infringements or breaches occurred under a pervious version of these conditions.  We may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from the 1st of March, 2014.

Returns & Refunds


We want your experience to be a positive one, we are happy to help anyway we can.  If you have any questions or need any help, please do not hesitate to contact us.  We sincerely mean that.


General

We offer a return policy for merchandise, goods, and products (herein known as "products) as follows:

-Products must be returned within 14 days of order date or verified date of receipt of products indicated by tracking/delivery service if the customer requested that shipping method

-Products must be un-used, in original packaging, and contain all items that were present when new

-Products must be in sellable condition free from any signs of use, damage, installation, or wear

-Products must be returned to Timm Training & Consulting and the customer is responsible for the safe delivery of products


To initiate a return you must contact us and request a return authorization number, no returns will be accepted with out prior authorization.  The customer is responsible for any return shipping rates or fees and the original shipping rate or fees will not be refunded.


Any products that is defective when received maybe returned for an exchange of the same product only, or a warranty claim may be made directly to the manufacturer.


There is no refunds or returns on any sale, special purchase, or group buy items.  All of those items are sold as is, all sales final.  Items in those categories will be listed as such in either the title, description, or attributes.  In the event a payment is received for a group buy item and the group buy is cancelled, the payment will be refunded and/or account credited to the customer with in 3 business days of the group buy cancellation date.  The customer has the choice of receiving a refund by check or having store credit to be used on other merchandise or training/services.  Please order carefully.


Training Courses

There are no refunds after a student as attended and completed a training course.  If a student is unsatisfied with the training course that was conducted by Timm Training & Consulting LLC, the customer must contact us and file a petition explaining why they feel that way.  Upon receipt and approval of petition the customer will receive a non-transferable certificate valid for a course of equal or lesser value valid for one year from the date of the original course.  


For hosted courses, the customer is responsible for knowing and understanding the hosted instructor's refund and return policy.  


Full refunds will be issued to customers who cancel registration prior to 30 days of the course date.  Cancellations received with in 30 days of the course date may receive a refund or may receive a non-transferable voucher valid for a future course of equal or lesser value that expires one year from the original course date.  This decision is made on a case by case basis at the sole discretion of the company.  Factors that are considered include resources or materials already purchased for the class by the company, as well as lease agreements, rental fees, range fees and other expenses or fees paid by the company.  We would love to offer a refund all of the time, and believe me we really are flexible, however if we have already made investments in good faith for the class you registered for, you may receive a a voucher if you cancel within 30 days of the class.


We can not be responsible for logistical issues that cause delays or schedule changes, these situations could include national disasters, acts of war, acts of god, location availability, hazardous weather that would make training unsafe, or other reasonable issues.  Likewise we encourage all of our students to plan a prepare accordingly as we can't be responsible for you delayed flights, road delays, travel issues, in-climate weather etc.



Training Terms of Service

We want your training experience to be a positive one, we are happy to help anyway we can.  If you have any questions or need any help, please do not hesitate to contact us.  We sincerely mean that.

By registering and/or attending you are acknowledging that you wish to participate in training, seminar or other course of instruction or event with Timm Training & Consulting LLC.  You are aware that there are dangers related to this activity and I hereby state and affirm that you will abide by and follow at all times the following safety rules, guidelines, and stipulations:

1. You will treat and assume all firearms are always loaded, all of the time. The only time you will handle a firearm is on the line of fire as instructed by the course instructor, or at a designated handling area(s) only after the firearm is confirmed to be clear and unloaded. It is required that the firearm is double checked, and preferably by an additional person. You understand handling a firearm in violation of this rule while person(s) are in proximity and/or down range may result in the termination of your participation.

2. You will keep my finger off of the trigger until your sights are aligned on target and you are ready to fire.

3. You will only point, index, or present your firearm at your intended target. You will never point my firearm at anything you are not willing to shoot.

4. You will be aware of your target, and what is beyond your target.

5. You will not be impaired by any alcohol, narcotic, drug, or substance while at the course and/or event.

6. You will not use any electronic devices while participating as you understand they can cause distractions and become a hazard.

7. You understand that any negligent discharge of a firearm in my possession, or in your control , may result in the termination of your participation of the course/event, and you may be ejected without refund. I understand this to include any round that was not intentional, a round that was fired beyond the berm and/or backstop exiting the range, or a discharge that caused an alarm for the safety of you or others.

8. You understand that if the instructor(s) feel that your performance is a safety concern, at their undisputed discretion, my participation may be modified or terminated.

9. You will learn and obey the rules of the range and location as stipulated by the location and abide by them and follow them and understand they have the same consequences as all rules set forth in the course or event. You will not intentionally damage, steal, take or borrow any property that is not yours including item(s) that I was not specifically given permission to handle.

Learning Firearms is a MN POST Board approved course sponsor and offers continuing educaltion credits for licensed peace officers.  Courses are conducted in compliance with regulations and guidlines.  All staff, students, and guests will be held to a standard of professionalism and has a policy on incidents of classroom discrimination and unproffesional standards.  This policy aslo address potential criminal acts and how incidents are investigated and handled.  A copy of the police is available here:

Learning Firearms Training Discrimination Policy

You are aware that there are risks related to this activity and you hereby state and affirm that:

1.  Your participation in this event is voluntary. You know and are aware of the risks associated with your participation in this course, and you acknowledge that firearms will be discharged with live ammunition. You acknowledge that this activity has the potential for danger, injury and the possibility of death.

2. You understand and agree that neither Timm Training & Consulting LLC (Herein known as “Company”), nor any person acting on behalf of the Company, including staff, agents, representatives, contracted staff, hosted instructors, volunteers, and/or property owners/controllers of event locations may be held liable in any way for any event which occurs in connection with activity that may result in injury, death or damage.

3. In consideration for being allowed to participate in the event, you hereby personally assume all risks in connection with this event and hereby release and hold harmless the Company, or anyone acting on behalf from liability for injury, death or damage which may befall you during this event, whether foreseen or unforeseen, however caused and whether or not caused by the negligence, active or passive, of the Company or any person acting on behalf.

4. The terms of this agreement shall serve as a release and assumption of risk for heirs, executor, administrator and all members of your family.

5. You further state that you understand that the terms herein are contractual and not a mere recital and that you acknowledge these terms on your own free act.

6. Your are of legal age to acknowledge these terms, or you will have a parent/guardian present that will sign on your behalf and be responsible for you and under their immediate direct supervision while you participate in the event.

7. You will abide by the commands of range staff, instructors, contracted instructors, and/or hosted instructors at all times and follow all rules of the range, location, instructors, staff, or special circumstances. You also understand that failure to do so may result in the termination of your participation in the event and you may be ejected without refund.

8. OPTIONAL - You will allow the use of my image either in still photography or video (including audio) format for use by the Company for promotional, advertising, or informative/review purposes with no compensation financial or otherwise. *You will have the option to decline at the event/class.


Due to the nature of our courses you may be required to provide credentials before being registered and/or admitted to class.  Qualified credentials could include:

-Proof of employment with a government agency, state, local, federal etc as a peace officer with powers of arrest

-Qualified retired credentials of the above

-Active duty member of the armed forces of the United States including National Guard and Reserves

-A permit to carry/purchase indicating you are legally authorized to own/possess a firearm

-A letter from an authorizing government agency acknowledging you have had a background check conducted  and you are legally authorized to own/posses a firearm


Registration is not finalized until a payment/deposit has been received by our office.  You will be notified when such payment as received and registration is confirmed.  If you register by any means and do not send a payment, you slot may go to someone else who completes registration and secures with a payment.  Payments are due 30 days prior to the first day of class, registration within 30 days of the class date requires payment at the time of registration.


For hosted courses, you are responsible for knowing and understanding the hosted instructor's policies including refund and cancellation polices.This information is available upon request.  Those policies may supersede our policies in matters of cancelation and refunds.


All range fees are due at the time of registration or at the beginning of class for hosted courses where an outside entity or organization handles registration.

We may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from the 1st of March, 2014.


Privacy Policy


Your privacy is extremely important to us and we know you are trusting us with your data.  Your information will not be sold, released, or given to anyone by us without a court order or your written consent.  In the event we are served a court order, we will take steps to ensure the order is lawful and legitimate before releasing any information.  If the order is found to be lawful and legitimate we will follow and comply with the applicable laws.  We know in this day and age your information is important and valuable to you, we operate our business how we would want a business to be operated if we were the customer.  If you sign up for our email list, register for a class, or make a purchase you have the option of staying on our email lists that are only generated by us.  If at any time you want to opt out, there are instructions on how to do so on every email.  We hate unwanted emails too so we will respect your wishes.

     -Your prior training experience to ensure you are qualified to be in the class or event for your safety and the safety of others

     -Your Peace Officer or professional license number, if applicable, for POST credits and/or continuing education credits

     -Your credentials such as permit to carry, background letter etc, this is to ensure you are legally able to participate in training


What we do with the information we gather

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

     -Internal record keeping

     -Maintaining training record for government compliance (POST Records for licensed Peace Officers)

     -We may use the information to improve our products and services

     -We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting

     using the email address which you have provided

     -From time to time, we may also use your information to contact you for market research and feedback purposes. We may contact you by

     email, phone, fax or mail. This is mainly for our feedback to make sure you are satisfied with your product, service, or class.  We don't like

     annoying surveys and don't expect you to.  However, your feedback is very valuable to us, how we can make our experience better only comes

     with feedback from you


Security

We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.  We have armed guards and watch dogs on premise, our dogs can not be bribed anything less that sirloin USDA Choice beef.  Cheap criminals who only bring hot dogs will be sorry.

Controlling your personal information

You may choose to restrict the collection or use of your personal information.  Whenever you are asked to fill in a form on the website, only fill out what information you want us to have.  For our email list we will obviously need your email address, but if you don't want to provide us your name, that's ok.  For class registration we do need accurate and complete information.  This ensures that you are who you say you are, not a convicted felon or someone otherwise ineligible for training.  You may be asked to provide agency identification or other proof that you are legally able to posses firearm(s) and ammunition.  In those cases your information will be verified and securely deleted, we have no interest of keeping, storing, or archiving your private information.  You may also choose to verify your information in person.


Release of Information

We will not sell, distribute or lease your personal information to third parties PERIOD.  If we are served a document, court order, warrant, or subpoena we may be required by law to do so. We may use your personal information to send you promotional information about upcoming training events, products, group buys and events, and related events and opportunities we think you may find interesting.  You may request details of personal information which we hold about you under the Data Protection Act 1998.  If you would like a copy of the information held on you please contact us.If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible. We will promptly correct any information found to be incorrect.
